All activity on the Site, including but not limited to browsing, account creation, policy applications, and transactions, is contractually
deemed to occur within the jurisdiction and geographic bounds of the Modoc Nation. By using the Site, you consent to the personal and
subject matter jurisdiction of the Modoc Nation’s courts and regulatory authorities.
2. Coverage Requests and Underwriting Approval
All requests to add, remove, or modify coverage are subject to underwriting approval. No change to coverage, limits, or insured drivers
is effective until an official endorsement has been issued in writing by Inuity Insurance. Submitting a request, application, or payment
does not, by itself, alter or extend coverage.
3. Nature of Coverage
Unless expressly stated otherwise in a written policy:
- No policies provide liability protection for injuries to others or damage to other property.
- Coverage offered is excess over the renter’s primary auto policy and is subject to the terms, conditions, exclusions, and limits set forth in the policy contract.
4. Regulatory Status and Surplus Lines Disclosures
- Inuity Insurance Company, Inc. is domiciled and regulated under the laws of the Modoc Nation, a federally recognized Indian tribe.
- Inuity is not admitted in any U.S. state.
- This Site is not an offer to sell insurance, nor is it a solicitation to purchase insurance, in any jurisdiction where such activity would be unlawful.
- To the extent a policy is deemed to be sold in a state where Inuity is not an authorized insurer, such coverage is provided under that state’s surplus lines or export provisions for special risks where no admitted or non-admitted carrier offers coverage.
- No state insurance guaranty fund or association provides protection in the event of Inuity’s insolvency.
5. Intellectual Property
All content on this Site, including but not limited to text, graphics, logos, trademarks, and software, is the property of Inuity or its licensors.
You may not copy, modify, distribute, or create derivative works without express written consent.
6. User Responsibilities
By using this Site, you agree not to:
- Misrepresent your identity or eligibility for insurance products.
- Attempt to gain unauthorized access to systems, accounts, or data.
- Use the Site for unlawful purposes or in violation of these Terms.
7. Limitation of Liability
To the fullest extent permitted by law, Inuity and its officers, employees, and affiliates disclaim liability for any damages arising from
your use of the Site, except as expressly required under applicable policy contracts.
8. Governing Law and Jurisdiction
These Terms, and all activity conducted on or through the Site, are governed by and shall be construed exclusively under the laws of the
Modoc Nation. By using the Site, you irrevocably consent to the personal and subject matter jurisdiction of the Modoc Nation’s courts for
all disputes arising out of or related to your use of the Site, policies, or transactions.
9. SMS Messaging Terms (10DLC Compliance)
- By providing your mobile number, you consent to receive SMS messages from Inuity Insurance related to account security, authentication, policy updates, and transactional communications.
- SMS messages are strictly transactional and may include one-time passcodes (OTPs), login confirmations, password resets, and account security alerts.
- Message and data rates may apply. Frequency of messages will vary depending on account activity.
- You may opt out at any time by replying STOP. After opting out, you will no longer receive verification or account-related messages by SMS.

- Delivery of SMS messages is subject to your carrier’s availability, and Inuity Insurance is not responsible for delayed or undelivered messages.
10. Electronic Transactions and Consent
By using this Site, you agree to conduct transactions electronically and consent to the use of electronic records, signatures, and
communications. Electronic communications, including SMS messages, shall have the same legal force and effect as if in writing.
If you do not consent, you must discontinue use of the Site.
11. California Consumer Rights

We implement commercially reasonable safeguards to protect personal information collected through the Site and SMS communications.
